Notice of Intent to Adopt a Rule
  • Title 68 Indiana Gaming Commission -- #01-23 (PDF)

    -- Adds a new rule to: (1) stipulate the qualifications and conditions that must be included in all engagement arrangements a riverboat makes with independent accounting agencies to perform financial statement audits; and (2) to specify requirements for notice to the Indiana gaming commission about such audits and their progress. Adds a new rule requiring supplier licensees and supplier license applicants to: (1) maintain records; and (2) to require them to allow the Indiana gaming commission access to those records. Adds a new rule to require logs to be created by riverboat licensees in association with card and dice removal and cancellation and to specify the requirements of those logs. Amends 68 IAC 2-2-1 to conform the rule to a directive from the legislature to delete the requirement that a supplier of alcoholic beverages is required to hold a supplier's license. Amends 68 IAC 2-3-5 to clarify who should retain possession of occupational licenses and badges at the various phases of licensure. Amends 68 IAC 2-6-6 to require a riverboat licensee requesting permission to convert an electronic gaming device to inform the commission of the regular fill amount, initial fill amount, and probe level measured from the top of the hopper. Amends 68 IAC 3-3-6 to change the date by which the riverboat licensees and license applicants must submit reports concerning the performance of their continuing obligation to meet the minority and women owned business goals established in IC 4-33-14-5. Riverboat licensees and license applicants will be required to file reports reflecting expenditures made during the previous calendar year by January 31 of the following year. Amends 68 IAC 10-2-1 to correct an error in that rule and bring the rules in line with the standard rules for the game of blackjack. Amends 68 IAC 11-2-7(b) to clarify that meter reading reports need only be submitted to the Indiana gaming commission on a monthly basis. Amends 68 IAC 11-5-1(c) to correct the conflict with 68 IAC 15-4-3(5) so that secondary chip inventories will be rotated and counted on a monthly basis. Amends 68 IAC 14 to require that all table layouts have the name of the riverboat licensee imprinted on the layout. Amends 68 IAC 15-2-3 and 68 IAC 15-2-6 to revise the information required to be included on currency transaction reports so it will agree with the revised Internal Revenue Service Currency Transaction Report form. Amends 68 IAC 15-4 to specify the manner in which suppliers and riverboats must ship chips and tokens. Amends 68 IAC 15-4-3 to require commission approval of procedures for performing chip inventories and sealing and accessing of locked compartments used for the storage of chips or tokens. Amends 15-7-3 to: (1) eliminate the need for riverboat licensees to investigate variations of $500 in Electronic Gaming Device win; and (2) to correct an error of word choice in 68 IAC 15-7-3(h). Amends 68 IAC 15-8-1 to require the internal audit department to include at least two on-site internal auditors and to stipulate that quarterly reports of compliance testing shall identify repeat findings and state corrective action taken to avoid similar problems in the future.     -- Adds 312 IAC 4 to govern personnel matters within the division of law enforcement of the department of natural resources. Restructures ranking of officers. Modifies procedures for taking administrative review of disciplinary actions. Reduces categories within the primary law enforcement responsibility of conservation officers. Simplifies selection procedures for applicants to become conservation officers. Eliminates the requirement that a board of survey review act upon lost or damaged division property, and places discretion in the division director to convene a board of review as needed to assist with this function.   • Title 345 Indiana State Board of Animal Health -- #01-1 (PDF)

    -- The rule will amend requirements for control of rabies in dogs, cats, and ferrets, including requirements for transporting animals into Indiana and requirements for exhibition in Indiana. The rule will add and amend requirements for rabies vaccination of dogs, cats, and ferrets. The rule may allow dogs and cats to be vaccinated for rabies every three years under certain circumstances.     Amends 357 IAC 1-3 to provide editorial and technical revisions to the rule pertaining to the distribution of restricted use pesticides. Clarifies the intent to include, as a dealer, those business locations that broker restricted use pesticide sales and distribution. Deletes the requirement to report names of external sales representatives to the state chemist.

    Amends 405 IAC 1-8-3 to add a definition for essential hospital services and revise the reimbursement methodology for essential hospital services.     Amends 820 IAC 2-2-1 to change the reciprocity requirements for individuals who apply for a cosmetology, electrologist, or esthetician instructor license. Adds 820 IAC 2-2-1.1 to require individuals submitting an examination application to include a photograph. Adds 820 IAC 2-2-1.2 to require an applicant to bring photo identification to an examination and to produce the photo for inspection. Amends 820 IAC 2-2-3 to eliminate the age requirement for an individual submitting an examination application for manicurists and shampoo operators and to add an age requirement for an individual submitting an examination application. Amends 820 IAC 2-2-5 to clarify that an unsuccessful applicant may repeat the instructor written examination and to change the additional required instruction. Amends 820 IAC 2-2-6 to clarify that an unsuccessful applicant may repeat the cosmetology written examination and to eliminate the requirement that an applicant who fails the repeat instructor examination will not be allowed to repeat the examination. Amends 820 IAC 2-2-7 to clarify that an unsuccessful applicant may repeat the manicurist written examination and to change the additional required education to the fifth written examination and odd-numbered attempts. Amends 820 IAC 2-2-8 to clarify that an unsuccessful applicant may repeat the electrologist written examination and to change the additional required instruction to repeat the examination. Amends 820 IAC 2-2-9 to clarify that an unsuccessful applicant may repeat the shampoo operator written examination and to change the additional required instruction to repeat the examination. Amends 820 IAC 2-2-10 to clarify that an unsuccessful applicant may repeat the esthetician written examination, to change the additional required instruction to repeat the examination, and to change the additional education required to the fifth written examination and odd-numbered attempts. Amends 820 IAC 3-2-9 to change the sanitary and equipment requirements for esthetics students in cosmetology schools. Amends 820 IAC 3-2-19 to require 12 pairs of protective gloves on the premises. Amends 820 IAC 4-1-1 to change the courses cosmetology schools may offer and to change to whom cosmetology schools may offer courses. Amends 820 IAC 4-1-5 to eliminate the requirement to attend cosmetology school for no more than eight hours a day; to change the number of instruction hours permitted off the school premises; and to reduce the time students enrolled in cosmetology school have to complete the required education. Amends 820 IAC 4-1-11 to eliminate the requirement that education requirements have to be completed on the premises of an Indiana cosmetology school and to change the minimum number of education hours needed to graduate from cosmetology school. Amends 820 IAC 4-1-12 to change the completion of a student's application by cosmetology school and to eliminate the prohibition that a cosmetology or esthetics student is required to attend school after graduation. Amends 820 IAC 4-2-1 to change the number of square footage required for a cosmetology school. Amends 820 IAC 4-2-2 to change the cosmetology school requirements for classrooms; to require a cosmetology school to have a laboratory area; to require a cosmetology school to use a clock or computer to record the date or day and time a student attends school; and to require restrooms in cosmetology schools to be located within the 3,000 square foot area. Amends 820 IAC 4-2-3 to change the type of equipment cosmetology schools are required to have. Amends 820 IAC 4-3-1 to establish the licensure requirements for individuals teaching manicuring in cosmetology schools. Amends 820 IAC 4-4-4 to add specific curriculum requirements for cosmetology training. Amends 820 IAC 4-4-7.1 to remove one of the instruction requirements for estheticians curriculum. Amends 820 IAC 4-4-7.2 to change the required cirriculum for instructor training. Amends 820 IAC 4-4-10 to change the type of practical experience required for students in cosmetology training. Amends 820 IAC 4-4-11 to remove the eyebrow and lash tinting practical experience and performance requirements and to increase the minimum number of practical experience and performance requirement for waxing. Amends 820 IAC 4-4-14 to add the practical experience and performance requirement for the electric file/drill for manicurists; to remove the practical experience and performance requirement for pedicures and nail techniques; to reduce the number of performances for salesmanship, and to change the practical experience title for salesmanship. Amends 876 IAC 3-5-1 to modify the education offerings that satisfy the continuing education requirements and to clarify that continuing education requirements must be satisfied within the two year renewal period as a prerequisite to renew. Adds 876 IAC 3-5-1.5 to establish mandatory continuing education courses and requirements.
