    Adds 312 IAC 2-4 concerning the regulation of watercraft engaged in fishing tournaments or other organized activities. Amends 312 IAC 8-5-2 that addresses licenses on DNR properties. Repeals 312 IAC 8-3.

  • Title 312 Natural Resources Commission -- #01-15 (PDF)

    Adds 312 IAC 4 to govern personnel matters within the division of law enforcement of the department of natural resources. Modifies procedures for taking administrative review of disciplinary actions. Reduces categories within the primary law enforcement responsibility of conservation officers. Simplifies selection procedures for applicants to become conservation officers. Eliminates the requirement that a board of survey review act upon lost or damaged division property and places discretion in the division director to convene a board of review as needed to assist with this function.     -- The State Board of Tax Commissioners intends to amend the 50 IAC 2.3, the rule concerning the 2002 Real Property Assessment Manual. The amendment will either change or delete certain requirements regarding obligation of a county assessor to select specific guidelines to be used in their county for the next general reassessment. The purpose of the amendment will be to create more leeway in how and when county assessors must make the required selection. The State Board of Tax Commissioners invites written suggestions, facts, arguments, or views in these matters.     -- Adds a new section to 312 IAC 5, that governs the operation of watercraft on public waters in Indiana, to establish restrictions on Prairie Creek Reservoir in Delaware County. A speed limit of 20 miles per hour would be established for all watercraft. Motorboats would be prohibited from towing water skis and similar objects north of a line extending westerly from the bridge over Huffman Creek on County Road 560 East.     -- Amends 405 IAC 1-12 to establish Medicaid reimbursement criteria for certain Community Residential Facilities for the Developmentally Disabled (CRFs/DD) licensed as small extensive needs residence for adults.     -- Amends 405 IAC 5-24-4 to add that reimbursement for legend drugs reimbursed by the Indiana Health Coverage programs shall be the lower/lowest of the following: (1) The estimated acquisition cost of the drug as of the date of dispensing, plus any applicable Medicaid dispensing fee. (2) If applicable, the federal maximum allowable cost (MAC) of the drug (as determined by the Centers for Medicare and Medicaid Services under 42 CFR 447.332) as of the date of dispensing, plus any applicable Medicaid dispensing fee. (3) If applicable, the state maximum allowable cost (MAC) of the drug (as determined by the office) as of the date of dispensing, plus any applicable Medicaid dispensing fee. (4) The provider's submitted charge, representing the provider's usual and customary charge for the drug, as of the date of dispensing; minus a recipient copayment amount, where applicable.     -- The Indiana Board of Accountancy intends to change the experience requirements for certified public accountants to bring the requirements into conformity with statutory changes by changing the types of experience required before a certificate or license may be issued, requiring a licensee to verify an applicant's experience to meet the requirements of IC 25-2.1-3-10, revising the use of an advance degree as experience, and repealing out-of-date language. Revise the fee schedule for certificate of registration for CPAs, PAs, and APs and for firm permits.     Adds 35 IAC 1.2-6-7 regarding plan loan procedures for making loans to participants from the legislators' defined contribution plan. Establishes maximum loan amounts, maximum loan duration, and other procedural requirements for receiving a loan pursuant to Section 72(p) of the Internal Revenue Code.

    Adds 50 IAC 4.3 for the assessment of tangible personal property.     Amends 170 IAC 1-1.1-1 to clarify which cases and other matters under commission jurisdiction are governed by the new rules of practice and procedure and which are governed by the former rules of practice and procedure.   • Title 312 Natural Resources Commission -- #01-34 (PDF)

    Amends 312 IAC 8-2-2, 312 IAC 8-2-6, and 312 IAC 8-5-3, rules that govern the public use of DNR properties. The discharge of sink, shower, and other gray water through drains onboard a boat would be prohibited. A license would be required for the release of any animal on a DNR property. In addition to a property manager, any person authorized by the director could (subject to administrative review) restrict or reject a person from a DNR property for misconduct for a period not to exceed one year. Clarifies that a restriction or ejection can apply to all or any portion of a particular property, to multiple DNR properties, or to all DNR properties. Makes other technical changes.

  • Title 312 Natural Resources Commission -- #01-124 (PDF)

    Amends 312 IAC to make changes to conform rules to statutes, to conform with rule recodifications from 310 IAC to 312 IAC, to conform with agency restructuring, and to provide other technical corrections. Includes amendments to the definition of 'public freshwater lake' and to standards for underwater beaches. Clarifies application of property use rules to the Indiana State Museum.

    Amends 326 IAC to change any incorporation by reference of the Federal Register to its CFR citation published in the July 1, 2000, edition of the Code of Federal Regulations (CFR). Amends 326 IAC 1-1-3 concerning references to the CFR to update any references to the CFR in Title 326 to mean the July 1, 2000, edition. Adds 326 IAC 1-1-3.5 and 326 IAC 1-2-20.5 to establish references to and definition of the Compilation of Air Pollution Emission Factors AP-42 and Supplements.

    Amends 345 IAC 1-6 to add and remove diseases in animals that must be reported to the Indiana state board of animal health. Makes other changes in the law of reporting diseases in animals. Repeals 345 IAC 1-6-1.

    Amends 345 IAC 7-3.5 to reflect changes made in IC 15-2.1-14 by the Indiana general assembly, including eliminating fees for livestock dealer licenses and eliminating annual renewal of licenses.   • Title 405 Office of the Secretary of Family and Social Services -- #01-175 (PDF)

    Adds 405 IAC 2-3-1.2 concerning Medicaid penalties for transferring assets for less than fair market value. Specifies that the purchase of an annuity or similar arrangement is considered a transfer of assets for less than fair market value unless the annuity is irrevocable, commercially issued, actuarially sound, and provides substantially equal monthly payments with no balloon payment.

    Amends 405 IAC 2-3-1.1 to specify the method for calculating the Medicaid eligibility penalty for transferring income. Specifies that when the right to a stream of income is transferred for less than fair market value, the penalty is calculated based on the projected total income expected to be transferred during the individual's lifetime. Specifies that a transfer of income includes, but is not limited to, (1) transferring income-producing real property; and (2) accepting less than the fair market rental value when property is rented. Specifies that, for purposes of the Medicaid eligibility penalty for transferring assets for less than fair market value, 'assets' includes any income or resources which the applicant or recipient or the applicant's or recipient's spouse is entitled to receive, but does not receive because of failure to take action to receive those assets. Repeals 405 IAC 2-3-1.
