    Adds 312 IAC 2-4 concerning the regulation of watercraft engaged in fishing tournaments or other organized activities. Amends 312 IAC 8-5-2 that addresses licenses on DNR properties. Repeals 312 IAC 8-3.

    Adds 312 IAC 4 to govern personnel matters within the division of law enforcement of the department of natural resources.     -- The State Board of Tax Commissioners intends to amend the 50 IAC 2.3, the rule concerning the 2002 Real Property Assessment Manual. The amendment will either change or delete certain requirements regarding obligation of a county assessor to select specific guidelines to be used in their county for the next general reassessment. The purpose of the amendment will be to create more leeway in how and when county assessors must make the required selection.   • Title 312 Natural Resources Commission -- #01-34 (PDF)

    Amends 312 IAC 8-2-2, 312 IAC 8-2-6, and 312 IAC 8-5-3, rules that govern the public use of DNR properties. The discharge of sink, shower, and other gray water through drains onboard a boat would be prohibited. A license would be required for the release of any animal on a DNR property. In addition to a property manager, any person authorized by the director could (subject to administrative review) restrict or reject a person from a DNR property for misconduct for a period not to exceed one year. Clarifies that a restriction or ejection can apply to all or any portion of a particular property, to multiple DNR properties, or to all DNR properties. Makes other technical changes.

  • Title 312 Natural Resources Commission -- #01-124 (PDF)

    Amends 312 IAC to make changes to conform rules to statutes, to conform with rule recodifications from 310 IAC to 312 IAC, to conform with agency restructuring, and to provide other technical corrections.     Adds 405 IAC 2-3-1.2 concerning Medicaid penalties for transferring assets for less than fair market value. Specifies that the purchase of an annuity or similar arrangement is considered a transfer of assets for less than fair market value unless the annuity is irrevocable, commercially issued, actuarially sound, and provides substantially equal monthly payments with no balloon payment.

    Amends 405 IAC 2-3-1.1 to specify the method for calculating the Medicaid eligibility penalty for transferring income. Specifies that when the right to a stream of income is transferred for less than fair market value, the penalty is calculated based on the projected total income expected to be transferred during the individual's lifetime. Specifies that a transfer of income includes, but is not limited to, (1) transferring income-producing real property; and (2) accepting less than the fair market rental value when property is rented. Specifies that, for purposes of the Medicaid eligibility penalty for transferring assets for less than fair market value, 'assets' includes any income or resources which the applicant or recipient or the applicant's or recipient's spouse is entitled to receive, but does not receive because of failure to take action to receive those assets. Repeals 405 IAC 2-3-1.
