    -- The intent of the rule is to prescribe a uniform consolidated adjusted gross income tax filing methodology. The public is encouraged to submit written comments on the need for the rule, the drafting of the rule, and any other subject thought relevant to this rulemaking action. Statutory authority: IC 6-8.1-3-3.

  • Title 50 State Board of Tax Commissioners -- #01-98 (PDF)

    -- IC 6-1.1-31.5 provides for the State Board of Tax Commissioners to adopt rules related to county computer systems that process and maintain property tax assessment records, forms, and notices. Under the authority of IC 6-1.1-31-1, IC 6-1.1-31-2, IC 6-1.1-31.5-2, and IC 6-1.1-31.5-4, the Board intends to amend the previously adopted rules, 50 IAC 12, concerning county computer systems for property tax assessments. The primary purpose of the amendments will be to make changes that conform the existing computer standards to the form and requirements of the new 2002 general reassessment rules to be codified as 50 IAC 2.3 (the existing computer standards were designed to conform with the requirements of the old 1995 reassessment rules.) The State Board of Tax Commissioners invites written suggestions, facts, arguments, or views in these matters.   • Title 50 State Board of Tax Commissioners -- #01-99 (PDF)

    -- IC 6-1.1-31-1(b) allows the State Board of Tax Commissioners to adopt rules related to the duties or procedures of the Board. IC 6-1.1-31-11 requires the State Board of Tax Commissioners to adopt rules to govern proceedings before the property tax assessment board of appeals ('PTABOA') and the state board of tax commissioners ('SBTC') under IC 6-1.1-15. Under the authority of IC 6-1.1-31, the Board intends to amend the previously adopted rules, 50 IAC 17, relating to procedural requisites, standards, and practices for filing property tax assessment appeals, the presentation of evidence, and other general matters related to the manner in which hearings before PTABOA and SBTC must be conducted.   • Title 312 Natural Resources Commission -- #01-91 (PDF)

    -- Amends 312 IAC 23-3 to authorize a modification of previously approved certifications of the Indiana state historic rehabilitation tax credit. The division would be authorized to seek modifications based upon allegations of misrepresentation, fraud, or similar good cause through a complaint filed with the commission. The division would be authorized to modify the credit, if caused by statutory changes subsequent to certification, upon the issuance of an administrative letter.     -- Amends the provisions within 312 IAC 9 that govern hunting deer by firearms, hunting deer by bow and arrows, urban deer zones, use of crossbow, hunting of deer in confined areas, turkey, grouse, brown trout, largemouth bass, walleye, channel catfish, fish sorting and a prohibition on waste, charter fishing, yellow perch, ice fishing, whooping cranes, sandhill cranes, aquaculture permit, and the meaning of 'sale' as it applies to native reptiles and amphibians.     -- The rule will add a definition of registered technician and written instructions for a registered technician. Clarifies that a noncertified person using pesticides under the off-site supervision of a certified applicator must be a registered technician. Establishes a limit on the number of registered technicians to be supervised by a certified applicator. Establishes the requirements to become registered and reregistered as a technician.     Adds 312 IAC 4 to govern personnel matters within the division of law enforcement of the department of natural resources. Modifies procedures for taking administrative review of disciplinary actions. Reduces categories within the primary law enforcement responsibility of conservation officers. Simplifies selection procedures for applicants to become conservation officers. Eliminates the requirement that a board of survey review act upon lost or damaged division property, and places discretion in the division director to convene a board of review as needed to assist with this function. Makes numerous other substantive and technical changes. Repeals 310 IAC 1.2.

    Amends 872 IAC 1-1-6.1 to define first time examination applicant and to change the educational requirements for certified public accountants by changing the accreditation standards for programs from which applicants must graduate and by revising out-of-date language. Repeals 872 IAC 1-1-6.

  • Title 905 Alcohol and Tobacco Commission -- #01-12 (PDF)

    Amends 905 IAC 1-15.2-3 to add that a minor in that part of a restaurant premises that has no bar shall be considered to be loitering unless he or she meets the currently enumerated criteria in this rule as the rule now exists.
