Notice of Public Comment Period for Rule Readoption

Readopts rules in anticipation of
IC 4-22-2.6, providing that an administrative rule adopted under
IC 4-22-2 expires January 1 of the fifth year after the year in which the rule takes effect unless the rule contains an earlier expiration date. Effective 30 days after filing with the publisher.

The Department of Correction (department) is statutorily obligated for the promulgation of standards governing the operation of local and county jail facilities as well as ensuring compliance with standards as required by law (
IC 11-12-4-1). Jail Standards under
210 IAC 3 were first adopted in 1981. The department seeks to readopt the current standards in place without any changes which otherwise are scheduled to expire on January 1st, 2025.
REQUEST FOR PUBLIC COMMENT
The department is soliciting public comment on rules expiring under
IC 4-22-2.6. Comments may be submitted in one of the following ways:
