TITLE 60 OVERSIGHT COMMITTEE ON PUBLIC RECORDS

Notice of Intent to Adopt a Rule
LSA Document #20-633

Under IC 4-22-2-23, the Oversight Committee on Public Records intends to adopt a rule concerning the following:

OVERVIEW: Adds 60 IAC 5, which establishes a privacy committee to review requests for access to mental health records. Without a rule to allow for researchers to use these records, each file would only be accessible to direct descendants of the patient. The privacy committee will ensure that each request for access is reviewed by multiple people. The committee will also determine if access to the records is needed for the proposed research, and that all necessary precautions are taken to protect the identities of the patients. Statutory authority: IC 5-15-5.1-20; IC 16-39-2-6.

Resources available to regulated entities through the small business ombudsman include the ombudsman's duties stated in IC 5-28-17-6, specifically IC 5-28-17-6(9), investigating and attempting to resolve any matter regarding compliance by a small business with a law, rule, or policy administered by a state agency, either as a party to a proceeding or as a mediator.
