TITLE 41 OFFICE OF ADMINISTRATIVE LAW PROCEEDINGS

Notice of Intent to Adopt a Rule

Under IC 4-22-2-23, the Office of Administrative Law Proceedings intends to adopt a rule concerning the following:

OVERVIEW: Adds 41 IAC to establish a code of judicial conduct, which sets forth duties and ethical requirements to promote fair practices and unbiased decisions made by administrative law judges employed by the Office of Administrative Law Proceedings. A copy of the proposed rule is available for public inspection by appointment and may be requested by contacting the Small Business Regulatory Coordinator. Public comments may also be delivered to the Small Business Regulatory Coordinator for this rule using the address below. Statutory authority: IC 4-15-10.5-10.

Resources available to regulated entities through the small business ombudsman include the ombudsman's duties stated in IC 5-28-17-6, specifically IC 5-28-17-6(9), investigating and attempting to resolve any matter regarding compliance by a small business with a law, rule, or policy administered by a state agency, either as a party to a proceeding or as a mediator.
