TITLE 560 INDIANA EDUCATION EMPLOYMENT RELATIONS BOARD

Notice of Intent to Adopt a Rule

Under IC 4-22-2-23, the Indiana Education Employment Relations Board intends to adopt a rule concerning the following:

OVERVIEW: Amends, adds, or repeals sections in 560 IAC 2 to update definitions in 560 IAC 2-1 to reflect changes in terminology, undefined terms, or removal of outdated terms; modernize and simplify rule language regarding composition of or amendment to units and representation matters formerly under 560 IAC 2-2 as new rule 560 IAC 2-2.1; simplify and repeal rules to rely more upon IC 4-21.5-3 for unfair labor practices formerly under 560 IAC 2-3 as new rule 560 IAC 2-3.1; update 560 IAC 2-4 to reflect current IEERB practices for impasse and factfinding; reflect IEERB authority under 560 IAC 2-5 for collection of certain information; adopt electronic filing guidelines, mediation rules, appointment of ad hocs, and general updates under 560 IAC 2-6; repeal facsimile filing 560 IAC 2-7; update compliance rules under 560 IAC 2-8 to reflect current practices; and generally correct and update 560 IAC 2. Statutory authority: IC 20-28-9-1.5; IC 20-29-2; IC 20-29-3-11; IC 20-29-5; IC 20-29-6-6.1; IC 20-29-8.

Resources available to regulated entities through the small business ombudsman include the ombudsman's duties stated in IC 5-28-17-6, specifically IC 5-28-17-6(9), investigating and attempting to resolve any matter regarding compliance by a small business with a law, rule, or policy administered by a state agency, either as a party to a proceeding or as a mediator.
