1. NOTICE: Under IC 4-22-7-7, this document is required to be published with the Indiana Register and is effective on its date of publication. It shall remain in effect until the date it is superseded or deleted by the publication of a new document in the Indiana Register. The publication of the document will provide the general public with information about the Alcohol and Tobacco Commission's (ATC) official position concerning a specific issue.

2. DISCLAIMER: This nonrule policy is being established by the ATC consistent with the authority under IC 7.1-2-3-7. It is intended solely as guidance and shall be used in conjunction with applicable rules or laws. It does not replace applicable rules and laws, and, if it conflicts with these rules or laws, the rules or laws shall control.

5. SUBJECT: The purpose of this nonrule policy is to implement a uniform procedure for receiving and processing applications for artisan distiller's permits.

6. SCOPE: An applicant for an artisan distiller's permit after January 1, 2014, must hold one (1) of the three (3) permit types listed in IC 7.1-3-27-5(a)(1) for the three (3) year period immediately preceding the date of the application.

7. POLICY:
7.1 Pursuant to IC 7.1-3-27-5(a)(1), an applicant for an artisan distiller's permit received after January 1, 2014, must hold one (1) of the following permits for the three (3) year period immediately preceding the date of the application:
7.1.1 A farm winery permit under IC 7.1-3-12.
7.1.2 A brewer's permit issued under IC 7.1-3-2-2(b).
7.1.3 A distiller's permit under IC 7.1-3-7.
7.2 Pursuant to IC 7.1-3-1-3 a permit is valid upon final commission approval.
7.3 For the purposes of IC 7.1-3-27-5(a)(1), a permit is considered "held" by the permittee on the date the commission votes to grant the permit.
