On behalf of the Indiana Department of Insurance (IDOI), I am submitting this notice in compliance with IC 4-22-2-19, which requires an agency to begin the rulemaking process not later than 60 days after the effective date of the statute that authorizes the rule, unless a notice is filed with the Publisher stating the reasons for the agency's noncompliance.

The Proposed Rule formalizes procedures the IDOI is currently implementing to carry out P.L.278-2013 regarding the certification of navigators and registration of application organizations. Since the enactment of P.L.278-2013, the IDOI has sought input from various state agencies and interested parties with respect to the Proposed Rule, and continued to do so after the Notice of Intent was posted on January 28, 2015 (DIN: 20150128-IR-760150033NIA).

The IDOI is proceeding with the rulemaking process, and expects the rule to be approved or deemed approved by the Governor or withdrawn under IC 4-22-2-41 by June 30, 2016.
