TITLE 590 INDIANA LIBRARY AND HISTORICAL BOARD
Notice of Intent to Adopt a Rule

Under
IC 4-22-2-23, the Indiana Library and Historical Board intends to adopt a rule concerning the following:
OVERVIEW: Adds
590 IAC 5-1.1 to replace the existing rule on definitions. Amends
590 IAC 5-2-1 to update a cross-reference. Amends
590 IAC 5-2-3 to allow a person who holds a specialist certificate on January 1, 2023, to renew the specialist certificate in certain circumstances. Amends
590 IAC 5-3-1 to remove language concerning new applications for specialist certificates. Amends
590 IAC 5-3-2 to allow LEUs used to renew a temporary permit to include LEUs earned after the person's start date and before the initial temporary permit took effect. Amends
590 IAC 5-3-3 to change "temporary certificate" to "temporary permit". Amends
590 IAC 5-3-4 to eliminate the requirement that a person must earn 20 technology LEUs to renew a 5-year certificate, to allow a library professional to earn 1 LEU for attending an escorted library tour for a maximum of 5 LEUs for different library tours during a 5-year period, and extends the period of time a librarian must retain LEU records to 90 days from the later of the date the certificate expired or the actual date the certificate was renewed. Allows LEUs earned to renew a 5-year certificate to include LEUs earned after the person's start date and before the initial 5-year certificate took effect. Amends
590 IAC 5-4-2,
590 IAC 5-4-3, and
590 IAC 5-4-4 to change references to "American Library Association accredited master of library science or equivalent" to "ALA accredited master's degree". Amends
590 IAC 5-4-6 to change the reference to educational requirement from years of college to number of college semester or quarter credits. Amends
590 IAC 5-4-7 to change "library experience" to "library work experience". Amends
590 IAC 5-4-7.5 to specify what levels of librarian certificates a director of a library serving a population of 3,000 or less can hold other than a Librarian Certificate 7, and removes the option of substituting 3 library science courses for 3 years of library work experience in keeping with the requirement that the director take certain workshops each of the first 3 years the person holds the position. Repeals
590 IAC 5-1,
590 IAC 5-4-8,
590 IAC 5-4-9,
590 IAC 5-4-10,
590 IAC 5-4-11, and
590 IAC 5-4-12. Effective January 1, 2023. Statutory authority:

IC 5-28-17-6, specifically
IC 5-28-17-6(9), investigating and attempting to resolve any matter regarding compliance by a small business with a law, rule, or policy administered by a state agency, either as a party to a proceeding or as a mediator.
