Amends 345 IAC 5-3-3 to update the incorporation by reference of the United States Department of Agriculture Animal and Plant Health Inspection Service, Scrapie Eradication Uniform Methods and Rules to the Scrapie Program Standards Volume 1: National Scrapie Eradication Program, dated April 25, 2019. Amends 345 IAC 5-7-2 to update the incorporation by reference of the Voluntary Scrapie Flock Certification Program (SFCP) Standards to Volume 2, dated May 2016. Effective 30 days after filing with the Publisher.




SECTION 1. 345 IAC 5-3-3 IS AMENDED TO READ AS FOLLOWS:

345 IAC 5-3-3 Incorporation by reference

Sec. 3. (a) The board adopts and incorporates by reference the following:
(1) The following provisions of the United States Department of Agriculture Animal and Plant Health Inspection Service, National Scrapie Eradication Uniform Methods and Rules, June 1, 2005 Program, Scrapie Program Standards Volume 1, effective April 25, 2019:
(A) Part II (M) (N) Movement Restrictions.
(B) Part VII – Epidemiology.
(2) 9 CFR 54.8 and 9 CFR 54.9, in effect on January 1, 2020.
Where provisions of the Uniform Methods and Rules National Scrapie Eradication Program, Scrapie Program Standards Volume 1 conflict with this article, the express provisions of this article shall control.

(b) Copies of the National Scrapie Uniform Methods and Rules Eradication Program, Scrapie Program Standards Volume 1 may be obtained from the office of the state veterinarian. by calling (317) 227-0315.

345 IAC 5-7-2 Incorporation by reference

Sec. 2. (a) The board adopts and incorporates by reference the United States Department of Agriculture Animal and Plant Health Inspection Service, Voluntary Scrapie Flock Certification Program (SFCP) Standards, July 1, 1999 Volume 2, May 2016. This document will be referred to in this rule as the certification program standards.

(b) Copies of the Scrapie Flock Certification Program Standards may be obtained from the office of the state veterinarian. by calling (317) 227-0315.

(c) Where provisions of the certification program standards conflict with this article, the express provisions of this article shall control.
