TITLE 312 NATURAL RESOURCES COMMISSION

Emergency Rule

DIGEST

Temporarily amends 312 IAC 9-3-4 to govern hunting white-tailed deer in a designated county under an extra deer license by identifying counties for herd reduction. Effective September 1, 2020.


SECTION 1. (a) This SECTION supplements 312 IAC 9-3-4(g) and governs hunting deer under an extra deer license in a designated county.

(b) A person may take an antlerless deer under this SECTION only if:
(1) issued a license to hunt deer with:
(A) a resident extra deer bonus antlerless license under IC 14-22-11-10(a) or IC 14-22-12-1(a)(18);
(B) a nonresident extra deer bonus antlerless license under IC 14-22-12-1(a)(19);
(C) a resident youth consolidated hunting, fishing, and trapping license under IC 14-22-11-10(b) or IC 14-22-12-1(a)(24);
(D) a nonresident youth extra deer bonus antlerless license under IC 14-22-12-1(a)(32);
(E) a resident extra deer license bundle under IC 14-22-11-10(a) or IC 14-22-12-1(a)(18);
(F) a nonresident extra deer license bundle under IC 14-22-12-1(a)(19);
(G) a nonresident youth extra deer license bundle under IC 14-22-12-1(a)(32);
(H) an apprentice license of the types identified in clauses (A) through (G) under IC 14-22-12-1.7;
(I) a lifetime comprehensive hunting license under IC 14-22-12-7(a)(4) before its repeal; or
(J) a lifetime comprehensive hunting and fishing license under IC 14-22-12-7(a)(5) before its repeal; or
(2) hunting deer without a license under IC 14-22-11-1 and 312 IAC 9-2-14.

(c) The season for hunting deer under this SECTION is as follows:
(1) From September 26 through 27, 2020, with a bow and arrow, crossbow, firearm, or muzzleloading gun.
(2) From October 1, 2020, through January 3, 2021, with a bow and arrow or crossbow.
(3) From November 14, 2020, through November 29, 2020, with a firearm or muzzleloading gun.
(4) From December 5, 2020, through December 20, 2020, with a muzzleloading gun.
(5) From December 26, 2020, through January 3, 2021, with a firearm or muzzleloading gun.

(d) The seasonal limit for hunting under this SECTION is one (1) antlerless deer for each deer license issued under this SECTION, with the exception of the resident youth consolidated hunting and trapping license, extra deer license bundles, and lifetime comprehensive hunting licenses listed in subsection (b).

(e) An individual who hunts under this SECTION may use a bow and arrow, crossbow, muzzleloading gun, or any firearm that may otherwise be lawfully used to take deer under 312 IAC 9-3, IC 14-22-2-8, and IC 14-22-2-9.

(f) 312 IAC 9-3-2(b) through 312 IAC 9-3-2(d) and 312 IAC 9-3-2(m) through 312 IAC 9-3-2(z) apply to a license issued under this SECTION.

(g) An individual must not exceed the county bag limit from each county as follows:

A county bag limit of "A", as used in this subsection, is one (1) antlerless deer. Notwithstanding subsection (c), a deer taken under this SECTION in a county with a bag limit of "A" must be taken only from November 26, 2020, through January 3, 2021.

SECTION 2. (a) This SECTION is supplemental to 312 IAC 9-3-4 and governs the activities of an individual who is hunting deer on the following department properties:
(1) Anspaugh Wetland Conservation Area.
(2) Ashcraft Wildlife Management Area.
(3) Atterbury Fish and Wildlife Area.
(4) Aukiki Wetland Conservation Area.
(5) Austin Bottoms Conservation Area.
(6) Badal Trust Area.
(7) Beaver Dam Wetland Conservation Area.
(8) Big Barbee Wetland Conservation Area.
(9) Bittern Bog Wetland Conservation Area.
(10) Blue Grass Fish and Wildlife Area.
(11) Bob Kern Nature Preserve.
(12) Boones Pond Public Fishing Area.
(13) Brownstown Public Fishing Area.
(14) Carlson Gamebird Area.
(15) Cartmell Gamebird Area.

(b) On the department properties listed in this SECTION, an individual may take not more than:
(1) two (2) antlerless deer with archery equipment authorized in 312 IAC 9-3-3(b) during the archery season in accordance with 312 IAC 9-3-4(c) with a license type authorized in 312 IAC 9-3-2(f); and
(2) one (1) antlerless deer with a muzzleloading gun authorized in 312 IAC 9-3-3(e) during the muzzleloader season in accordance with 312 IAC 9-3-4(f) with a license type authorized in 312 IAC 9-3-2(i).

(c) An individual may not take an antlerless deer on these properties from September 26, 2020, through January 3, 2021, except as authorized in subsection (b) and SECTION 2 of this document.

SECTION 4. (a) This SECTION is supplemental to 312 IAC 9-3-4 and governs the activities of an individual who is hunting deer on Greene-Sullivan State Forest.

(b) On the department property listed in this SECTION an individual may take not more than:
(1) two (2) antlerless deer with archery equipment authorized in 312 IAC 9-3-3(b) during the archery season in accordance with 312 IAC 9-3-4(c) with a license type authorized in 312 IAC 9-3-2(f);
(2) one (1) antlerless deer with a muzzleloading gun authorized in 312 IAC 9-3-3(e) during the muzzleloader season in accordance with 312 IAC 9-3-4(f) with a license type authorized in 312 IAC 9-3-2(i); and
(3) three (3) antlerless deer from October 1, 2020, through January 3, 2021, with a license type authorized in SECTION 1 [of this document] with:
(A) archery equipment authorized in 312 IAC 9-3-3(b) during the archery season in accordance with 312 IAC 9-3-4(c); or

(B) muzzleloading gun authorized in 312 IAC 9-3-3(e) during the firearms season in accordance with 312 IAC 9-3-4(e) and muzzleloader season in accordance with 312 IAC 9-3-4(f).

(c) An individual may not take an antlerless deer on the property listed in subsection (a) from September 26, 2020, through January 3, 2021, except as authorized in subsection (b) and SECTION 2 of this document.

SECTION 5. (a) This SECTION is supplemental to 312 IAC 9-3-4(h).

(b) The special antlerless deer season is from December 26, 2020, through January 3, 2021.

(c) During the special antlerless deer season an individual may take antlerless deer in any county with an antlerless quota other than an "A".

SECTION 6. SECTIONS 1 through 5 of this document take effect September 1, 2020.

SECTION 7. SECTIONS 1 through 5 of this document expire on February 1, 2021.
