IC 4-22-2.1-5 Statement Concerning Rules Affecting Small Businesses
There is an estimated fiscal impact of zero on all persons regulated by the proposed rule. Persons regulated by this rule are administrative law judges employed by the Office of Administrative Law Proceedings (OALP). No businesses are regulated by the proposed rule. There are no direct or indirect fees imposed by this rule.

Regulatory Flexibility Analysis of Alternative Methods:
The OALP has submitted draft versions of this rule to potentially regulated persons as well as to interested parties and has revised the rule several times for various reasons, one of which is to remove regulation from the rule and implement those standards of regulation in internal OALP policy and procedure instead of through rule promulgation. To the extent this rule regulates affected persons, the regulated individuals are already bound by the state of Indiana code of ethics and many other regulated persons are currently bound by the Rules of Professional Conduct for Attorneys, both of which have a similar "spirit" of fairness and unbiased practice.
Explanation of Preliminary Determination:
The OALP has not made a determination that the rule was necessary because the promulgation of such rule by the OALP is mandated under
IC 4-15-10.5-10.
